Terms of Service

These Terms of Service (“Terms”) govern your use of the OnDeck mobile application for iPhone and Apple Watch (the “App”) and the website ondeck.kickstepinc.com (together, the “Services”), operated by Kickstep Inc. (“Kickstep,” “we,” “us”). By creating an account or using the Services, you agree to these Terms.

1. Eligibility and accounts

You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Services. You are responsible for the accuracy of your account information and for keeping your credentials secure.

2. Health and safety disclaimer

OnDeck provides fitness programming, not medical advice. Exercise carries inherent risk of injury. Consult a physician before starting any exercise program, especially if you have a medical condition, are pregnant, or have been inactive. Stop exercising immediately if you feel pain, dizziness, or shortness of breath. The App’s workout suggestions are estimates based on the information you provide; you alone are responsible for judging whether a task is safe for you, for using proper form and equipment, and for scaling or skipping any task. Use of the Mercy Rule is always available and encouraged when needed.

3. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, subject to these Terms and Apple’s App Store terms. You may not reverse engineer, copy, resell, or misuse the Services.

4. Your content and data

You retain ownership of the data you record in the App. You grant us a license to process it as needed to operate the Services, as described in our Privacy Policy.

6. Subscriptions and purchases

If the App offers paid features, purchases are processed by Apple through your App Store account and are subject to Apple’s terms, including its refund policies. Prices and features may change with notice.

7. Disclaimer of warranties

The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the Services will be uninterrupted or error-free.

8. Limitation of liability

To the maximum extent permitted by law, Kickstep will not be liable for indirect, incidental, special, consequential, or punitive damages, or for personal injury arising from your exercise activities. Our total liability for any claim relating to the Services will not exceed the greater of US$50 or the amount you paid us in the twelve months before the claim.

9. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate access for violation of these Terms, with notice where practicable.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in the App or on this page. Continued use after changes take effect constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which Kickstep Inc. is incorporated, without regard to conflict-of-law rules.
